Global Patent Prosecution Highway: An Option for Quicker Examination and Allowance of Your Patent Application

Started on January 6, 2014, the Global Patent Prosecution Highway (PPH) is a pilot project involving the intellectual property offices of 16 countries including Canada, the United States, Australia, China, Denmark, Finland, Germany, Hungary, Iceland, Israel, Japan, Korea, Mexico, Norway, Portugal, Russia, Spain, Sweden, and the United Kingdom, as well as 1 regional patent office, the Nordic Patent Institute (comprised of the Danish, Norwegian and Icelandic Patent Offices).

The Global PPH allows a patent applicant to request accelerated examination of a pending application by amending the claims of the pending application to be identical or nearly identical to the allowed or granted claims of a corresponding application or patent in one of the other participating Global PPH countries. By requesting accelerated examination under the Global PPH, a pending application has a higher likelihood of being allowed and proceeding to grant, and in less time, based on the allowed or granted claims of a corresponding case. In addition, accelerated examination requested under the Global PPH currently requires no additional government fee than the existing application filing, prosecution and maintenance fees.
